1. Acceptance of Terms

By registering on, accessing, or using the INFLUEAT platform ("Platform"), whether as an Influencer ("Creator") or Restaurant Partner ("Partner"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the Platform. Continued use after updates constitutes acceptance of revised Terms.

2. Platform Description

INFLUEAT connects food and lifestyle influencers with restaurant partners. Creators receive wallet-based dining credits in exchange for creating and posting authentic content on social media. Restaurant Partners receive genuine user-generated content (UGC) and increased footfall.

INFLUEAT is a technology intermediary and does not operate, control, or assume responsibility for the services provided by Restaurant Partners, including food quality, hygiene, service, or any aspect of the dining experience.

3. Eligibility & Registration

  • You must be at least 18 years of age to register.
  • All information provided during registration must be accurate and complete. INFLUEAT reserves the right to reject or terminate accounts with false or misleading information.
  • Creator accounts are subject to review and approval by INFLUEAT administration. Approval is at the sole discretion of INFLUEAT and may be revoked at any time.
  • Each user may maintain only one account. Duplicate accounts will be terminated.

4. Wallet Credits & Payments

  • Credits are not currency. Wallet credits are non-transferable, non-refundable promotional benefits provided at the discretion of INFLUEAT. They hold no cash value and cannot be exchanged for money.
  • Variable payment. Creators enter the exact bill amount when paying via the Platform. The entered amount is deducted from the wallet balance, subject to per-visit and weekly caps determined by the Creator's tier.
  • Weekly reset. Wallet balances may be reset on a weekly basis. Unused credits do not roll over unless otherwise specified.
  • Tier assignment. INFLUEAT assigns Creator tiers based on social media metrics and content quality. Tier assignment is at the sole discretion of INFLUEAT and may be changed at any time.
  • Diamond tier. Diamond is an exclusive, invite-only tier. Benefits for Diamond creators are individually determined by INFLUEAT administration and are not subject to standard tier configurations.
  • Platform fee. A service fee is charged to Restaurant Partners on each transaction. The fee amount is determined by INFLUEAT and may be adjusted at any time.

5. Content Requirements & Proof Submission

  • After each wallet payment, Creators must submit content proof (Instagram stories, posts, or reels as required by their tier) within 48 hours.
  • Failure to submit proof within the deadline will result in a strike. Three strikes lead to account suspension.
  • Content must be authentic, original, and clearly tag the restaurant and INFLUEAT. Fake, recycled, or misleading content will result in immediate suspension or ban.
  • INFLUEAT reserves the right to reject content proof that does not meet quality standards.
  • By posting content, Creators grant INFLUEAT a non-exclusive, royalty-free, worldwide license to use, display, and redistribute the content for promotional purposes.

6. Restaurant Availability & No Guarantee

INFLUEAT does not guaranteethat any restaurant will be available for credit redemption at any given time. Availability depends on the Restaurant Partner's remaining monthly budget, operational capacity, and active status on the Platform.

  • Restaurants may be marked as "Fully Booked", "Filling Fast", or temporarily disabled when their budget is exhausted or nearing capacity.
  • Creators are advised to check restaurant availability on the Platform before visiting. Walk-in redemptions are subject to restaurant availability at the time of visit.
  • INFLUEAT is not liable for any expenses, inconvenience, or loss incurred if a restaurant is unable to honor a redemption due to budget exhaustion, closure, or any other reason.
  • Pre-booked slots, where available, provide priority but are still subject to restaurant operational constraints.

7. Prohibited Conduct

The following actions are strictly prohibited and will result in immediate suspension or permanent ban:

  • Creating fake or fraudulent accounts, or using someone else's Instagram identity.
  • Colluding with Restaurant Partners to generate fake transactions or inflated billing.
  • Attempting to manipulate, exploit, or reverse-engineer the QR code system.
  • Sharing account credentials or wallet access with any third party.
  • Posting negative, defamatory, or harmful content about Restaurant Partners in connection with INFLUEAT transactions.
  • Using bots, automated tools, or artificial engagement to inflate social media metrics.
  • Any activity that INFLUEAT, at its sole discretion, deems harmful to the Platform, its partners, or its community.

8. Restaurant Partner Terms

  • Partners agree to honor all valid wallet payments made by approved Creators.
  • Partners set a monthly budget which determines the number of Creator visits they can accommodate. Once the budget is exhausted, the Partner will be marked as unavailable until the next billing cycle.
  • A platform service fee is charged on each transaction. By registering, Partners agree to the applicable fee structure, which may be updated with prior notice.
  • Partners must not discriminate against Creators or provide inferior service compared to regular paying customers.
  • Partners grant INFLUEAT the right to display their restaurant name, logo, cuisine type, and other business information on the Platform.
  • INFLUEAT is not responsible for the content posted by Creators. Any concerns about specific content should be raised through the Platform's support channels.

9. Account Suspension & Termination

  • INFLUEAT may suspend or terminate any account at its sole discretion, with or without cause, and with or without notice.
  • Upon suspension or termination, all unused credits are forfeited. No refund or compensation will be provided.
  • Users may request account deletion by contacting support. Deletion is permanent and irreversible.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • INFLUEAT shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from use of the Platform.
  • INFLUEAT is not responsible for the quality, safety, or legality of food or services provided by Restaurant Partners.
  • INFLUEAT does not guarantee uninterrupted or error-free operation of the Platform.
  • Total liability of INFLUEAT shall not exceed the value of credits available in the user's wallet at the time of the claim.

11. Privacy & Data

  • INFLUEAT collects and processes personal data necessary for Platform operations, including name, email, phone number, Instagram handle, and transaction history.
  • Creator profiles (name, tier, Instagram handle) may be displayed publicly on the Platform's trending or leaderboard pages, subject to Creator consent settings.
  • INFLUEAT may share aggregated, anonymized data with Restaurant Partners for analytics purposes.
  • INFLUEAT will not sell personal data to third parties.

12. Intellectual Property

The INFLUEAT name, logo, design system, and all Platform content are the intellectual property of INFLUEAT. Users may not copy, reproduce, or use any Platform branding without written permission.

13. Dispute Resolution

  • All disputes shall first be attempted to be resolved through INFLUEAT's internal support channels.
  • If unresolved, disputes shall be subject to binding arbitration in Bangalore, India, under the Arbitration and Conciliation Act, 1996.
  • These Terms are governed by the laws of India. Courts in Bangalore, Karnataka shall have exclusive jurisdiction.

14. Changes to Terms

INFLUEAT reserves the right to modify these Terms at any time. Material changes will be communicated via email or Platform notification. Continued use after changes constitutes acceptance.
